Creates an exception to the requirement that alternative fueling facility grant recipients must make facilities publicly accessible before non-public facilities can receive grants

Exempts facilities owned or operated by transit authorities governed by Chapter 451 or 452 of the Transportation Code from the public accessibility prioritization requirement

The exemption applies only to facilities located in counties with populations exceeding one million

Facilities must also be located in a nonattainment area or affected county (as defined in Section 386.001, Health and Safety Code) to qualify for the exemption

Takes effect September 1, 2025, and applies only to grant rounds beginning on or after that date
