TX HB2146

Creates a new civil cause of action allowing individuals to sue when someone intentionally removes, alters, or renders a condom less effective without consent and then engages in sexual contact

Defines "sexual contact" as contact between the anus or sexual organ of one individual and the anus or sexual organ of another, using the Penal Code definition of "consent"

Requires courts to award prevailing claimants actual damages (including mental anguish), court costs, and reasonable attorney's fees

Allows prevailing claimants to also recover exemplary (punitive) damages in addition to mandatory awards

Applies only to causes of action accruing on or after September 1, 2025
