Nursing facilities and assisted living facilities with elevators must install and maintain emergency generators or backup power sources capable of powering elevators for a minimum of 48 hours during power outages, along with sufficient fuel supply

Senior independent living communities (residential communities for individuals 55+ with at least 20 units and common amenities) with elevators face the same 48-hour backup power requirement for elevator operation

Violations carry civil penalties of up to $500 per month for nursing and assisted living facilities, and up to $1,000 per month for senior independent living communities, with the attorney general authorized to bring suit

Exemptions from the senior living community requirements include health care institutions, boarding homes, HUD Section 202 supportive housing, federally-defined centers for independent living, and facilities regulated by HHSC or CMS

Compliance deadline is March 1, 2026, with the act taking effect September 1, 2025
