Authorizes Texas postsecondary educational institutions (public and private colleges/universities) to offer "higher education health benefits" directly to enrolled students and their family members without being classified as engaging in the business of health insurance

Requires that enrollment in these health benefits be voluntary—institutions cannot mandate student participation in the program

Limits waiting periods for preexisting conditions to a maximum of six months for treatment otherwise covered under the health benefits

Mandates written disclosure to applicants that the benefits are not provided through a regulated insurance product, requiring signed acknowledgment before enrollment and retention of records during the coverage term

Requires participating institutions to register with the Texas Department of Insurance, administer benefits in an actuarially sound manner based on recommendations from a qualified actuary, and maintain appropriate cash reserves and stop-loss insurance coverage
