Creates a new criminal offense under Section 43.245 of the Texas Penal Code for adults (18 years or older) who communicate explicit descriptions of sexual conduct, sexual excitement, physical torture, or brutality to minors (under 18)

Defines "harmful to minors" communication as content that appeals to prurient interest, is patently offensive by adult community standards for minors, and is utterly without redeeming social value for minors

Applies to both verbal and written communications where the adult knows or reasonably should know the recipient is a minor

Classifies the offense as a Class A misdemeanor, which carries penalties of up to one year in jail and/or up to $4,000 in fines

Allows affirmative defenses from Section 22.011(e) (typically age-based defenses involving close-in-age relationships) and permits prosecution under this section, other applicable laws, or both

Takes effect September 1, 2025
