Public safety employees who successfully complete a public safety employees treatment court program (created under Chapter 129, Government Code) become eligible to have their arrest records and files expunged

Eligibility is limited to one-time use only; the person must not have previously received an expunction under this provision and must submit an affidavit attesting to that fact

Courts must enter an expunction order within 30 days of case dismissal, with consent of the prosecuting attorney; no fees or costs may be charged for expunctions under this provision

The public safety employees treatment court must provide the trial court with all defendant information required for an expunction petition when forwarding dismissal information

The law applies retroactively to persons who completed the treatment program before the effective date of September 1, 2025, regardless of when the underlying arrest occurred
