Expands drug court eligibility for adults and juveniles whose offenses involved firearms, dangerous weapons, use of force, or serious bodily injury when alcohol or controlled substance use contributed to the offense, but only if the prosecuting attorney consents to participation

Removes the previous blanket prohibition that automatically excluded individuals from drug court programs when their substance-related offenses involved weapons, force, or serious bodily injury

Maintains an absolute prohibition on drug court participation for any adult or juvenile whose substance-related offense resulted in the death of another person, regardless of prosecutor consent

Applies to defendants entering drug court programs under Chapter 123 of the Government Code regardless of when the offense was committed

Takes effect September 1, 2025
