Eliminates the pathway for students to qualify for in-state tuition by graduating from a Texas high school and maintaining continuous residence for three years prior to graduation plus one year before enrollment

Restricts residency status to two categories: individuals who established domicile in Texas at least one year before enrollment, or dependents whose parents meet the same one-year domicile requirement

Prohibits individuals not authorized under federal law to be present in the United States from being classified as Texas residents for tuition purposes

Allows public institutions of higher education to reclassify currently enrolled students as nonresidents before any semester if they no longer qualify under the new criteria or lack federal authorization to be in the U.S.

Takes effect September 1, 2025
