Indecent exposure is a Class B misdemeanor for a first offense, elevated to a Class A misdemeanor for defendants with one prior conviction under the same statute

Offense becomes a state jail felony if the defendant has two or more prior indecent exposure convictions, or has a prior conviction or deferred adjudication for a reportable sex offense under the sex offender registration requirements

Offense becomes a third-degree felony if the defendant is civilly committed as a sexually violent predator under Chapter 841 of the Health and Safety Code

Changes apply only to offenses committed on or after September 1, 2025; prior offenses remain governed by former law
