Water park entities (owners/operators of commercial water parks with pools, water slides, splash pads, lazy rivers, and associated facilities) receive limited liability protection for injuries, deaths, emotional distress, or property damage sustained by participants

Liability protection requires posting a warning sign in a clearly visible location at or near the water park entrance stating that Texas law limits the owner/operator's liability for injuries or death

Liability protection does NOT apply to injuries caused by: the water park's negligence regarding safety, known or reasonably knowable dangerous conditions, failure to properly train employees, or intentional harm

The law applies only to causes of action accruing on or after the effective date and is in addition to any other existing liability limitations

Takes effect immediately with two-thirds legislative vote, otherwise September 1, 2025
