Reduces the penalty for first-time possession of less than one gram of Penalty Group 1 controlled substances (such as cocaine, heroin, methamphetamine) from a state jail felony to a Class A misdemeanor with a mandatory minimum of 180 days confinement

Reduces the penalty for first-time possession of fewer than 20 abuse units of Penalty Group 1-A substances (such as LSD) from a state jail felony to a Class A misdemeanor with a mandatory minimum of 180 days confinement

Maintains state jail felony classification for repeat offenders who have prior convictions for controlled substance possession offenses

Keeps possession of less than one gram of Penalty Group 1-B substances (fentanyl and fentanyl derivatives) as a state jail felony regardless of prior criminal history

Allows judges to require completion of a substance abuse awareness educational program as a condition of community supervision for those convicted of the new Class A misdemeanor drug possession offenses
