Requires the Texas Commission on Environmental Quality (TCEQ) to deny air permit applications subject to new source review if facility emissions would have a disproportionately adverse effect on the health, property, or environment of low-income populations compared to other populations in the area

Mandates the commission consider both the individual effect of a proposed facility and the cumulative effect in conjunction with other proposed or existing facilities in the area when making permit determinations

Applies only to permit applications filed with TCEQ on or after the effective date; applications filed before that date remain governed by existing law

Takes effect September 1, 2025
