Creates a new criminal offense under Section 481.142 of the Health and Safety Code for operating premises for unlawful controlled substance consumption

Applies to anyone who owns, rents, leases, manages, or otherwise controls any premises (permanently or temporarily) and knowingly allows illegal drug use on that property

Covers three types of conduct: operating premises for illegal drug use, profiting from premises used for illegal drug consumption, or making premises available to others for illegal drug use (regardless of whether compensation is received)

Classifies the offense as a second-degree felony, which in Texas carries a punishment of 2-20 years imprisonment and up to $10,000 in fines

Effective date is September 1, 2025
