Adds a new definition of "economic benefit" for gambling offenses, limiting it to direct winnings from a game of skill or luck and excluding benefits received before a game starts or after winnings are paid out

Expands the definition of "private place" to include locations where the public cannot access without a valid membership, special invitation, or prior grant of permission

Changes the defense for gambling prosecution from an "affirmative defense" to a standard "defense," shifting the burden of proof and making it easier for defendants to claim the defense applies

The defense to prosecution requires that gambling occurred in a private place, no one received economic benefit other than personal winnings, and all participants had equal risks and chances

Applies only to offenses committed on or after the effective date; takes effect immediately with two-thirds legislative vote or September 1, 2025
