Creates a new criminal offense under Texas Penal Code Section 32.56 for fraudulent use, possession, or tampering with gift cards, gift card packaging, digital imprints, or gift card redemption information with intent to harm or defraud another person

Prohibits acquiring gift cards or redemption information without consent, altering or tampering with gift cards or packaging, using counterfeit or stolen gift cards to obtain goods or services, and placing tampered unactivated gift cards on retail displays to deceive consumers

Establishes a rebuttable presumption that possession of three or more gift cards, counterfeit cards, or digital imprints is without proper consent, though this presumption does not apply to legitimate businesses or government agencies

Penalties escalate based on the number of cards involved: state jail felony for fewer than 5 cards, third-degree felony for 5-9 cards, second-degree felony for 10-49 cards, and first-degree felony for 50 or more cards

Takes effect September 1, 2025
