Cited as the "Summer Willis Act," amends Section 22.011 of the Texas Penal Code regarding sexual assault prosecution

Expands the definition of non-consensual sexual assault to include situations where the actor knows the other person is intoxicated or impaired by any substance to the extent they are incapable of consenting

Removes the previous requirement that the actor must have "intentionally impaired" the victim by administering a substance without their knowledge, broadening prosecutorial scope

Adds a statutory definition of "consent" by referencing Section 1.07 of the Penal Code

Applies only to offenses committed on or after September 1, 2025; passed the House 129-4 and Senate 31-0
