Creates a legal defense for possession of controlled substances or marijuana when the substance is contained in a product labeled as a legal consumable hemp product authorized under state or federal law

Defense applies when the product contains controlled substances or marijuana beyond the hemp-derived concentrations permitted under Chapter 443, Subchapter E of the Agriculture Code

Requires the person to have purchased the product from a retailer they reasonably believed was authorized to sell consumable hemp products

Applies only to offenses committed on or after September 1, 2025; prior offenses remain governed by existing law

Amends Section 481.111 of the Health and Safety Code by adding new Subsection (c-1)
