Clarifies ownership rules: fluid oil and gas waste becomes the property of whoever takes possession of it for generating treated product, and ownership transfers again when the treated product or byproduct is transferred to another person for disposal or use

Expands tort liability protections for persons who produce, supply, or convey fluid oil and gas waste to treatment facilities, shielding them from liability for consequences of subsequent treatment, use of treated products, or exposure to byproducts

Preserves liability exceptions for gross negligence, intentional wrongful acts, or negligence combined with failure to comply with Railroad Commission rules or Texas Pollutant Discharge Elimination System permits

Prohibits exemplary damages in cases where liability is based solely on negligence and regulatory nonconformity, and requires the Railroad Commission to adopt rules governing treatment and beneficial use of fluid oil and gas waste, treated products, and byproducts
