Removes "testing" and "analyzing" from the definition of prohibited drug paraphernalia uses in the Texas Health and Safety Code, effectively decriminalizing equipment used to test or analyze controlled substances

Eliminates "testing equipment used or intended for use in identifying or in analyzing the strength, effectiveness, or purity of a controlled substance" from the specific list of items considered drug paraphernalia

Updates related criminal offense provisions to exclude testing and analyzing from the list of prohibited activities associated with drug paraphernalia possession, use, or delivery

Applies only to offenses committed on or after the effective date; offenses committed before remain governed by prior law

Takes effect September 1, 2025
