TX HB3207

Expands the intoxication assault offense to include causing "bodily injury" in addition to the existing "serious bodily injury" when operating a motor vehicle, aircraft, watercraft, amusement ride, or assembling a mobile amusement ride while intoxicated

Creates a new state jail felony classification for intoxication assault cases involving bodily injury, while maintaining the third-degree felony classification for cases involving serious bodily injury

Adds a second-degree felony enhancement for causing bodily injury to a peace officer in the actual discharge of official duty (previously only serious bodily injury to certain officials triggered enhanced penalties)

Maintains existing enhancements: second-degree felony for serious bodily injury to firefighters, EMS personnel, or peace officers on duty; first-degree felony for serious bodily injury to peace officers or judges on duty

Takes effect September 1, 2025, and applies only to offenses committed on or after that date
