Amends Section 51.352 of the Education Code to add that governing boards must nurture institutions to ensure "each and every student has an equal, meaningful opportunity to succeed in their academic and professional development"

Creates an exception to existing prohibitions on diversity, equity, and inclusion (DEI) activities at public higher education institutions when such activities fulfill the governing board's new mission of ensuring equal student opportunity

The exception would allow institutions to maintain DEI offices, hire DEI staff, require DEI statements, give preferences based on race/sex/ethnicity, and mandate DEI training if done to fulfill the equal opportunity mission

Maintains existing prohibitions on DEI activities except where required by federal law or for fulfilling the new governing board mission under Section 51.352(a)(4)

Takes effect September 1, 2025
