Requires persons constructing structures taller than 575 feet in qualifying counties to submit a review request to the Texas Parks and Wildlife Department at least 90 days before construction begins

Applies to counties with population under 500,000 that either border the Gulf of Mexico and contain a national wildlife refuge, or are adjacent to such counties and lack a municipality with population over 300,000

Department must provide written recommendations within 45 days to minimize impact on migratory birds; if no response is provided within that timeframe, construction may proceed without modification

Builders have 45 days to accept recommendations or propose alternative minimization measures; disputes over final measures may be appealed to the State Office of Administrative Hearings

Information submitted under this section is exempt from public records disclosure, and the act takes effect immediately with two-thirds vote or September 1, 2025
