School districts with 5,000 or more students are prohibited from assigning elementary students (grades 1-6) to the same uncertified, inexperienced teacher for two consecutive school years for foundation curriculum subjects

The restriction applies specifically to teachers with less than one year of teaching experience who do not hold the appropriate teaching certificate required under state law

Exceptions allow consecutive assignments if the parent and a school counselor or administrator agree to the arrangement, or if the student is in their first year after transferring into the district

The Commissioner of Education may grant waivers to districts facing "extreme circumstances" and may adopt rules to implement the requirements

The law applies beginning with the 2025-2026 school year and takes effect immediately with a two-thirds legislative vote, or September 1, 2025 otherwise
