School districts must excuse students from attending school for up to 5 days per school year for mental or behavioral health reasons

Districts are prohibited from requiring a statement from a healthcare professional to justify or verify the mental health absence

After a student's second excused mental health absence, the district may refer the student to a school counselor or other appropriate support personnel

Students with excused mental health absences cannot be penalized and will be counted as present for average daily attendance calculations

The law applies beginning with the 2025-2026 school year and takes effect immediately with a two-thirds vote or September 1, 2025
