TX HB3741

Requires non-U.S. citizens and non-permanent residents enrolled as students or employed at Texas public institutions of higher education to sign a sworn statement certifying they are not foreign agents

Defines "foreign agent" as a person intending to retrieve information, research, technology, materials, or other physical or intellectual property on behalf of a foreign government, quasi government, or terrorist organization

The sworn statement must affirm the individual is not a foreign agent of any government, quasi government, or terrorist organization hostile to the United States or Texas

Applies to all current and future foreign students and employees, regardless of when they enrolled or were hired

Takes effect immediately with two-thirds legislative vote, otherwise September 1, 2025; Texas Higher Education Coordinating Board may adopt rules for administration
