Prohibits the sale, distribution, or offering for sale of counterfeit lighters (imitations violating intellectual property laws) and unsafe lighters that fail to meet ASTM safety standards F400-20 for disposable/refillable lighters or F2201-20 for utility lighters

Applies to all sales channels including wholesale, retail, in-person, online sales, and free samples, but exempts interstate transportation through Texas and storage in warehouses not selling to Texas consumers

Imposes civil penalties up to $100 per lighter for manufacturers and wholesalers (capped at $100,000 per 30-day period) and retailers (capped at $25,000 per 30-day period) who knowingly violate the law

Authorizes the state fire marshal to adopt rules, inspect records and lighters of manufacturers, storage facilities, and sellers to verify compliance

Allows the attorney general to bring civil actions seeking injunctive relief and/or civil penalties against violators, with the act taking effect September 1, 2025
