Bars public nuisance claims in Texas courts when the alleged nuisance arises from activities authorized, licensed, approved, or mandated by any federal, state, or local government statute, regulation, permit, or order

Prohibits public nuisance claims where a statutory cause of action or administrative enforcement mechanism already exists to address the injurious conduct

Eliminates public nuisance claims based on products or their manufacturing, distribution, sale, labeling, or marketing, regardless of whether the product is defective

Prevents aggregating multiple individual injuries or private nuisances to form the basis of a public nuisance claim

Applies only to actions filed on or after the effective date, with immediate effect upon two-thirds legislative vote or September 1, 2025
