School districts must remove library materials from school libraries, classroom libraries, or online catalogs within 30 days of being notified that the materials do not adhere to standards adopted under existing library collection development policies

School district superintendents who fail to remove non-compliant library materials are personally liable for a civil penalty of up to $10,000 per violation

Each library material not removed constitutes a separate violation, though multiple copies of the same material count as only one violation

The Texas Attorney General is authorized to investigate alleged violations and bring legal action to recover civil penalties

The law applies beginning with the 2025-2026 school year and takes effect immediately with a two-thirds legislative vote, otherwise September 1, 2025
