Prohibits selling orthodontic devices (Class II or III medical devices used to move teeth/jaw, excluding retainers) to Texas patients unless the seller is a dentist who examined the patient or receives written confirmation from a dentist who did

Requires patients to receive an in-person intraoral and head/neck examination, plus review of diagnostic imaging (x-rays, CT scans, etc.) before obtaining orthodontic devices to detect contraindications such as untreated cavities, gum disease, cracked teeth, or dental implants

Mandates that patients receive a prescription from a dentist and counseling about treatment options and risks, with the patient signing written acknowledgment of receiving this counsel

Requires sellers and service providers to maintain documentation for at least 7 years after sale; prohibits dentists from requiring patients to use a particular type of orthodontic device as a condition of performing the required examination

Takes effect September 1, 2025, and applies only to orthodontic devices sold or services provided on or after that date
