Amends Section 403.609(b) of the Government Code regarding the comptroller's review of applications under the Texas Jobs, Energy, Technology, and Innovation Act

Limits the "compelling factor" requirement for competitive site selection to specific project types described in Section 403.602(8)(A)(i)(a), (c), (d) or (ii)

For those specified project types, the comptroller must still find that the tax agreement is a compelling factor in site selection and that without it, the applicant would not invest in Texas

Maintains existing requirements that projects must be eligible, generate sufficient tax revenue within 20 years to offset lost school district maintenance and operations tax revenue, and be located in a qualified opportunity zone if claimed

Takes effect September 1, 2025
