Video recordings of students made under special education setting surveillance requirements cannot be compelled through administrative subpoenas issued under Government Code Section 2001.089

Release of such video recordings via subpoena is only permitted if the release is already authorized under the existing provisions of Section 29.022 of the Education Code

Provides additional privacy protections for students in special education settings by limiting legal mechanisms that can force disclosure of surveillance footage
