Allows Medicaid residential facilities (group homes, host homes, and congregate care settings) under the HCS waiver program to refuse recipients if the facility has reached its service capacity as recorded in the commission's data system

Permits facilities to refuse recipients who have a history of or propensity for severe emotional behavior resulting in violence, or actions that could severely affect the health or safety of other residents

Authorizes refusal of recipients who are physically aggressive toward residents or staff and whose aggression is unresponsive to medical treatment, behavioral treatment, and redirection measures

Requires the Health and Human Services Commission to assess whether a facility has the capacity and capability to serve medically fragile recipients or those with serious bodily injuries before placement, based on the facility's current license

Prohibits the commission from requiring facilities to make modifications to accommodate recipients they cannot serve under their current authorization; effective date is September 1, 2025
