Expands the definition of "qualifying cogenerator" to include owners or operators of dispatchable generation that provide thermal, steam, or waste heat to a colocated desalination facility while serving loads primarily used for manufacturing digital products

Excludes these expanded qualifying cogenerators from being classified as retail electric providers, power generation companies, or retail electric utilities

Restricts this classification to facilities not located in areas where a municipally owned utility or electric cooperative is certificated to provide retail electric utility service

Takes effect immediately with a two-thirds vote of both legislative chambers, otherwise takes effect September 1, 2025
