Owners of private property directly adjacent to Parks and Wildlife Department-managed land may apply to install an access gate connecting their property to the state land and enter into an access agreement with the department

The department must review completed applications and issue a written decision within 90 days, considering factors such as environmental and wildlife impacts, security and safety concerns, and compliance with state and federal law

Access agreements must include restrictions on gate usage (hours and permitted purposes like personal or agricultural use), owner maintenance responsibilities, liability provisions indemnifying the department, and conditions for revoking access rights

Private property owners are responsible for all costs associated with the application review, gate installation, construction materials, labor, and ongoing maintenance, with fees determined by a commission-established schedule published on the department's website

The act takes effect September 1, 2025
