Removes enhanced assault penalties for individuals who are being apprehended or detained under an emergency detention order for mental health services (Chapter 573, Health and Safety Code)

Removes enhanced assault penalties for individuals with a pending application for court-ordered mental health services or who are currently committed to an inpatient mental health facility (Chapter 574, Health and Safety Code)

Specifically exempts these individuals from punishment increases under Penal Code Section 22.01 subsections (b)(1), (4), (5), and (9), which typically enhance penalties for assaults against certain protected classes of victims

Applies only to offenses committed on or after the effective date; prior offenses remain subject to existing law

Takes effect September 1, 2025
