Caps civil liability damages for nonprofit entities providing foster care or adoption services under state contracts, limiting damages to amounts specified in existing charitable organization law (Chapter 84, Civil Practice and Remedies Code)

Requires entities to meet specific conditions for liability protection, including conducting timely criminal background checks, verifying employees/volunteers are not listed in state registries as ineligible to work with children (checked every 5 years), and reporting misconduct allegations as required by law

Mandates child sexual abuse prevention training at least every 5 years and training on reporting child abuse and neglect for all employees, volunteers, caregivers, and clinical professionals

Limits vicarious liability for these entities, requiring claimants to prove the entity was not in substantial compliance with safety requirements, the requirement was designed to prevent the specific harm alleged, and the non-compliance was a substantial factor in causing the harm

Excludes gross negligence from the liability protections and applies only to causes of action accruing on or after September 1, 2025
