Amends Section 712.025 of the Health and Safety Code to allow perpetual care cemetery corporations to petition the district court in their county to use trust fund distributions for capital improvements

Currently, fund distributions may only be used to provide perpetual care as described in the establishing instrument, including general care and maintenance of cemetery property

Courts may grant petitions for capital improvement spending if the corporation demonstrates the expenditure will not adversely affect the cemetery's ability to provide ongoing perpetual care

Courts must also find that proposed capital improvements are in the best interest of the cemetery and families of those buried there who benefit from perpetual care

Takes effect September 1, 2025
