Municipalities with a population of 40,000 or more will have housing authority commissioners appointed by the presiding officer of the governing body (such as the mayor), while municipalities with populations under 40,000 will have commissioners appointed by majority vote of the entire governing body

Municipal housing authorities must be governed by 5, 7, 9, or 11 commissioners, and appointed commissioners cannot be officers or employees of the municipality

For housing authorities with 150 or fewer total units, the municipality is not required to appoint a tenant or housing assistance recipient as commissioner if timely vacancy notice was provided and the position cannot be filled within 60 days

Current commissioners appointed under existing law may serve out the remainder of their terms, with new appointment procedures taking effect as terms expire or vacancies occur

The act takes effect September 1, 2025
