Enhances intoxication assault (Section 49.07) to a second-degree felony if the defendant has one prior conviction for intoxication assault or intoxication manslaughter, or two prior convictions for any other intoxicated operation offense (motor vehicle, aircraft, watercraft, or amusement ride)

Maintains existing second-degree felony enhancement for intoxication assault causing serious bodily injury to a firefighter or emergency medical services personnel while on duty

Maintains existing first-degree felony enhancement for intoxication assault causing serious bodily injury to a peace officer or judge while on duty

Clarifies that intoxication manslaughter (Section 49.08) is elevated to a first-degree felony only when the victim is a firefighter, EMS personnel, peace officer, or judge performing official duties—not based on prior convictions

Applies only to offenses committed on or after September 1, 2025
