Property owners who file a lawsuit against their property owners' association (POA) may withhold assessment payments while the legal action is pending, regardless of provisions in dedicatory instruments or other laws

If the POA prevails in the lawsuit, the property owner must pay all withheld assessments and resume regular assessment payments

If the property owner prevails against the POA, the association is prohibited from filing suit to collect any assessments that were withheld during the litigation

Expands attorney's fees and court costs recovery to either party that prevails in certain POA-related legal actions, rather than only the association being entitled to such recovery

Applies only to actions filed on or after September 1, 2025
