Establishes the "Nicotine Access Protection Act" to revise definitions of cigarettes and tobacco products in the Health and Safety Code

Expands the definition of "cigarette" to include products intended to be burned or heated containing rolls of tobacco, herbs, or hemp wrapped in paper or other substances, regardless of whether they contain tobacco

Broadens "tobacco product" definition to include any product made of or derived from tobacco or containing nicotine, including synthetically derived nicotine, intended for human consumption, along with components, parts, and accessories

Exempts from regulation FDA-approved smoking cessation products with "Drug Facts" labeling, as well as products containing no nicotine or only trace amounts of naturally occurring nicotine that qualify as food, drugs, devices, or combination products under federal law

Moves statutory definitions for cigarettes and tobacco products from the Tax Code to Section 161.081 of the Health and Safety Code, effective September 1, 2025
