Counties with a population of 150,000 or less may establish and enforce programs requiring generators (fleet operators, tire recappers, retailers, wholesalers, or tire manufacturers) to mark used or scrap tires they handle

Each generator must be assigned a unique identifying mark to affix or imprint on every scrap or used tire they take possession of or produce

Customers must be allowed to retain scrap or used tires removed from their vehicles when purchasing new tires from retailers

Retailers must keep records when customers choose to retain their old tires, and the program must include a compliance inspection system for generators

"Used tire" is defined as a tire with at least one-sixteenth inch tread depth that can still serve its original purpose and meets Department of Public Safety requirements; the act takes effect September 1, 2025
