State registrars, local registrars, and county clerks must issue certified birth record copies free of charge to homeless individuals upon request

"Homeless individual" is defined as someone lacking a fixed, regular, and adequate nighttime residence, or whose primary residence is a temporary shelter, transitional housing, institution for temporary stays, or a place not designed for sleeping—excluding incarcerated individuals

The executive commissioner of the Health and Human Services Commission must adopt rules establishing a verification process for homeless status and prescribing required documentation

Homeless individuals cannot be required to provide a physical residential address to obtain their birth record

Takes effect September 1, 2025, applying to applications submitted on or after that date
