Allows a person to petition a court for a pre-suit deposition to perpetuate testimony for an anticipated action or to investigate a potential claim

Prohibits a person from requesting a pre-suit deposition if they have not sustained or do not reasonably expect to sustain actual damages in their anticipated claim

Makes a person who files a petition in violation of this requirement liable for the attorney's fees of each person they attempted to depose

Prevents the Texas Supreme Court from modifying or repealing this section through rulemaking authority

Takes effect immediately with a two-thirds vote of both legislative chambers, otherwise September 1, 2025
