Texas National Guard service members called to state active duty for 60 consecutive days or more become eligible for membership in the Employees Retirement System of Texas (ERS) employee class during their temporary state employment

Temporary state employee status for National Guard members is expanded to include benefits under Subtitle B, Title 8 of the Government Code (retirement system provisions)

The ERS must adopt rules for establishing membership and service credit, collecting contributions, and computing benefits for eligible National Guard members

Only service occurring on or after September 1, 2025 counts toward retirement system credit for affected service members

Service members already on state active duty for 60+ days on the effective date do not need to complete an additional waiting period; their hire date for retirement purposes is considered September 1, 2025
