Prohibits the Texas Education Agency from using artificial intelligence, automated scoring engines, or AI-based algorithms to score constructed responses (written answers) on public school assessment instruments

Continues to permit machine scoring for multiple choice responses on state assessments

Allows AI scoring methods as an exception if they meet three requirements: training on representative samples including educationally disadvantaged students, emergent bilingual students, and special education students; demonstrating validity and reliability consistent with National Assessment of Educational Progress standards; and certification by a qualified independent entity

Independent evaluation must certify the AI scoring method is valid and reliable, shows no measurable bias against disadvantaged student groups, and meets applicable psychometric standards

Applies beginning with the 2025-2026 school year and takes effect immediately with two-thirds legislative vote, otherwise September 1, 2025
