Managed care organizations that are public benefit corporations (as defined by Texas Business Organizations Code) receive a 5% increase to their bid score when competing for Medicaid managed care contracts

When two or more bids receive the same score, the Health and Human Services Commission must give preference to the organization that is a public benefit corporation

The bill maintains existing contract considerations, including preference for organizations with strong regional provider networks serving Medicaid and charity care patients, continuity of care commitments, and electronic claims processing capability

Applies only to contracts awarded on or after September 1, 2025, and implementation may be delayed if federal waiver or authorization is required
