The required notice must describe transfer on death deeds, including their benefits, impact on wills, and consequences of an owner dying without a will or transfer on death deed, plus information about executing such deeds at closing

Applies to residential real property including single-family homes, duplexes, triplexes, quadraplexes, and condominium or cooperative units

License holders must maintain a link to the notice prominently on their advertising websites and must advise buyers in writing at the time of signing a purchase offer that they may execute a transfer on death deed

Texas Real Estate Commission must adopt implementing rules by December 1, 2025, with the requirements taking effect January 1, 2026
