Creates Travis County Municipal Utility District No. 40 in Travis County, Texas, as a municipal utility district under Section 59, Article XVI of the Texas Constitution, encompassing approximately 56.62 acres across three tracts in the Augustus Kincheloe Survey

Grants the district authority to design, acquire, construct, finance, and maintain roads (macadamized, graveled, or paved) and storm drainage improvements, with road bonds payable from ad valorem taxes limited to one-fourth of the assessed value of real property in the district

Authorizes the district to issue bonds and impose ad valorem taxes, assessments, and fees following voter approval, with road project bonds requiring two-thirds majority voter approval

Establishes a five-member board of directors with temporary directors appointed by the Texas Commission on Environmental Quality upon petition by owners of a majority of assessed property value, serving until permanent directors are elected or four years expire

Limits eminent domain power if the Act does not receive two-thirds vote in both legislative chambers; takes effect immediately with two-thirds vote or September 1, 2025 otherwise
