Eliminates the pathway for students to qualify for in-state tuition based on graduating from a Texas high school and maintaining continuous residence for three years prior to graduation and one year before enrollment

Restricts resident status determination to two categories: individuals who established and maintained domicile in Texas for one year before enrollment, or dependents whose parents meet the same domicile requirements

Prohibits individuals not authorized under federal law to be present in the United States from being classified as Texas residents for tuition purposes

Allows public institutions of higher education to reclassify currently enrolled students as nonresidents before any semester if they no longer qualify under the new criteria or lack federal authorization to be in the U.S.

Takes effect September 1, 2025
